These Terms & Conditions ("Terms") govern your access to and use of the Food Detecto mobile application and related services (the "Service"), operated by Detecto LLP ("Detecto", "we", "us", or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
1. Eligibility & Accounts
- You must be at least 13 years old (or the minimum legal age in your jurisdiction) to use the Service.
- You agree to provide accurate, current, and complete information when creating your account and to keep it updated.
- You are responsible for maintaining the confidentiality of your account and for all activity that occurs under it.
- You must promptly notify us of any unauthorised use of your account.
2. The Service
Food Detecto is a food discovery and rewards platform that connects diners with participating restaurants. Users can discover restaurants nearby, view hero dishes, and claim a free dish when their bill meets the restaurant's minimum spend. Restaurant owners can list hero dishes, set minimum-spend rules, and verify claims. We do not own, operate, or prepare food at any restaurant and are not a party to the dining transaction between you and a restaurant.
3. Hero Dishes & Claims
- A "hero dish" is a free dish offered by a restaurant, subject to that restaurant's minimum-spend requirement.
- A claim is granted only if the bill amount entered and verified by the restaurant meets or exceeds the dish's minimum spend; otherwise it is rejected.
- Each user may hold only one pending claim at a time, and other limits may apply based on your plan.
- Claim approval is at the restaurant's discretion based on the verified bill. Detecto does not guarantee that any claim will be approved.
- Hero dishes are subject to availability and may be changed or withdrawn by restaurants at any time.
- Claims have no cash value and cannot be exchanged, transferred, or refunded.
4. Restaurant Owner Terms
- Restaurant owners are responsible for the accuracy of their listings, dishes, minimum-spend rules, and images.
- You must honour valid claims that meet your published minimum-spend requirement.
- You must hold all rights necessary for any content and images you upload.
- You are responsible for compliance with all applicable food-safety, tax, and business regulations.
5. Subscriptions & Payments
- Certain features are available through paid subscription plans for users and restaurants.
- Payments are processed securely through our payment partner, Razorpay. By subscribing, you authorise the applicable charges.
- Subscription benefits, limits, and pricing are described at the point of purchase and may be updated from time to time.
- Unless required by law or stated otherwise, payments are non-refundable. Subscriptions continue until cancelled in accordance with the plan terms.
6. Acceptable Use
You agree not to:
- Submit false, fraudulent, or abusive claims, or manipulate the claim process.
- Use the Service for any unlawful, harmful, or deceptive purpose.
- Attempt to reverse-engineer, interfere with, overload, or breach the security of the Service.
- Access or attempt to access another user's account or data without authorisation.
- Upload content that is illegal, infringing, offensive, or that you do not have the right to share.
7. Intellectual Property
The Service, including the Food Detecto name, logo, design, and software, is owned by Detecto LLP and protected by applicable intellectual-property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent. Content you submit remains yours, but you grant Detecto a non-exclusive, worldwide licence to use it as needed to operate and promote the Service.
8. Disclaimers
The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that restaurant listings, hero dishes, or claim outcomes will meet your expectations. Your dining experience and food quality are the responsibility of the restaurant, not Detecto.
9. Limitation of Liability
To the maximum extent permitted by law, Detecto LLP and its officers, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of or inability to use the Service. Our total liability for any claim relating to the Service shall not exceed the amount you paid us, if any, in the twelve months preceding the claim.
10. Suspension & Termination
We may suspend or terminate your access to the Service at any time, with or without notice, if you violate these Terms, engage in fraudulent or abusive activity, or for any other lawful reason. You may stop using the Service and request account deletion at any time. Provisions that by their nature should survive termination will continue to apply.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of India, without regard to conflict-of-law principles. You agree that the courts located in India shall have exclusive jurisdiction over any disputes arising out of or relating to these Terms or the Service.
12. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify you through the app. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
